摘要：Este trabalho explora as bases para uma formulação conceitual do papel dos direitos humanos na política democrática, tomando como ponto de partida as mudanças que ocorreram acerca desses direitos na década de 1990. Acreditamos que os direitos humanos não podem ficar restritos ao âmbito constitucional. Em outras palavras, a análise dos direitos humanos com base em uma analogia com os direitos constitucionais é passível de crítica. Por um lado, o modelo piramidal de Direito, suposto por essa analogia, tem sido objeto de questionamento teórico e prático nos últimos anos. Por outro, os direitos humanos têm um papel que vai muito além do que essa analogia também pressupõe, em virtude de seu caráter transnacional e de seu modo de inserção na dinâmica política democrática.
其他摘要：This paper explores the basis for a conceptual formulation on the role of human rights in democratic politics, having the changes in the 1990s as starting point. The human rights cant be restricted to the constitutional scope. In other words, the analysis of the human rights based on an analogy with the constitutional rights is well suited to criticism. On the one hand, the pyramidal model of Rights supposed by such analogy has been subject to theoretical and practical questioning in the past few years. On the other hand, the human rights have a much greater role due to their international nature and the way they are inserted in the democratic politic dynamics.
