摘要：Este artigo adota uma perspectiva que reconhece o protagonismo dos trabalha - dores na defesa de seus interesses coleti - vos e aborda a luta pelo reconhecimento dos sindicatos como atores legítimos no exercício de direitos. Primeiramente, apresenta a busca, por parte dos sindi - catos, do direito de participarem como substitutos processuais, representando os empregados em ações coletivas. Em se - guida, trata de suas estratégias para pro - mover mudanças em restrições jurídicas ao exercício do direito de greve, especial - mente os interditos proibitórios, que são usados para manter os grevistas longe das empresas e bancos. Por fim, aborda ou - tra importante iniciativa dos sindicatos no Judiciário, que é o uso da Convenção n. 158 da OIT e de princípios constitu - cionais em dissídios coletivos de natureza jurídica, com o objetivo de conquistar o direito de negociação coletiva antes de demissões coletivas.
其他摘要：This paper adopts a perspective that rec - ognizes the leadership of the workers in the defense of their collective interest. It approaches the struggle for recognition of trade unions as legitimate actors in the exercise of rights. It shows the attempts of these actors in order to participate as parts in the proceedings ( substitu - tos processuais ), as representatives of the employees in collective actions. It also deals with their strategies for promoting changes in the judicial restrictions of the right to strike, specially the prohibiting interdictions used to keep strikers away from firms and banks. Along with these subjects another important initiative of trade unions has been the use, in the col - lective disputes of legal nature (“ dissídios coletivos de natureza juridical ”), of the ILO Convention 158 and constitutional principles, in order to conquer favorable judicial interpretations and the right of collective negotiation in face of collective dismissals.
