摘要：El derecho a la protección de la salud todavía parece requerir una justificación frente a los poderes públicos que aún se niegan a garantizarlo por igual a todas las personas. Este artículo pretende, desde la Teoría de la Justicia de John Rawls, insistir en los potentes argumentos morales y de justicia que existen para fundamentar que el cuidado sanitario es un "derecho básico esencial". Además, se analizan las repercusiones constitucionales que ha tenido, en Chile, la reforma al sistema sanitario AUGE.

This paper tries, from the Theory of Justice of John Rawls, to insist on the powerful moral arguments that tries to found that the sanitary care is a "essential basic right".
