标题：EL ARTÍCULO 42 DE LA LEY DE CONCESIONES: JUSTICIA Y PROPORCIONALIDAD DE LA SANCIÓN. Comentario a la Sentencia del Tribunal Constitucional de fecha 26 de diciembre de 2006 (Rol N° 541-2006)
摘要：El trabajo comenta la sentencia del Tribunal Constitucional, de fecha 26 de diciembre de 2006 (Rol N° 541-2006), recaída sobre el artículo 42 de la Ley de Concesiones, que declaró constitucional dicha norma, centrando su crítica en lo débil de la argumentación, la cual, ajena a criterios de proporcionalidad y justicia que toda regulación exige, vulnera el derecho a la igualdad y a la seguridad jurídica que la Constitución protege. Por otra parte, el autor considera que la sentencia va en la dirección equivocada al considerar al sistema de concesiones como un bien jurídico digno de una protección constitucional especial, utilizando a las personas como un medio para el logro de dicho fin. Para terminar, concluye que el nuevo artículo que norma la imposición de sanciones en caso de no pago de peajes o tarifas, que actualmente se tramita en el Congreso, va, en líneas generales, en la senda correcta.
其他摘要：This work comments the sentence dictated by the Constitutional Court dated December 26, 2006 (N° 541-2006), which deals with article 42 of the Concessionary Law, declaring this law constitutional, centering its criticism on the weakness of the arguments, which, far away from justice and proportionality judgments which every regulation demands. Furthermore, the author considers that the sentence goes in the wrong direction about the concessionary system as a juridical right worth of special constitutional protection, using individuals as means to obtain his purpose. It concludes that the new article, presently in proceeding at congress, which regulates the imposition of sanctions in the case of unpaid tolls or tickets to the concessionary highways, it is in the right direction.
