标题：EL DERECHO A LA IMAGEN DE NIÑOS, NIÑAS Y ADOLESCENTES EN CHILE. UNA MIRADA CRÍTICA A LA LUZ DEL DERECHO INTERNACIONAL DE LOS DERECHOS HUMANOS Y DE LOS ESTATUTOS NORMATIVOS IBEROAMERICANOS DE PROTECCIÓN INTEGRAL DE LA INFANCIA Y DE LA ADOLESCENCIA
摘要：La inexistencia de normativas específi cas, tanto a nivel nacional como interna- cional, de protección del derecho a la imagen como derecho autónomo de la personalidad, en especial a favor de niños, niñas y adolescentes, ha generado graves problemas frente a la sanción de conductas lesivas de este derecho. El no contar con regulación especial al respec- to, sino solo con normativas genéricas derivadas de escasas normas constitucionales y civiles existentes referidas a otros derechos conexos, ha difi cultado, en efecto, la determinación de elementos claves para sancionar estas conductas. Esta situación ha sido objeto de crítica en la doctrina y en la jurisprudencia modernas, las cuales han realizado un esfuerzo por otorgar a este derecho una fi sonomía jurídica independiente, esfuerzo que se ha visto refl ejado en las últimas Leyes y Códigos de protección integral de la Infancia y de la Adolescencia publicadas en Iberoamérica.
其他摘要：The absence of a specifi c regulation, both domestically and internationally, of the right of personal portrayal as an independent personality right, especially for children and adolescences, has caused serious problems facing the punishment of harmful behaviors this right of personality, for not having a special laws, but only with generic rules derived from the few existing constitutional and civil rights, has hampered, in fact, the determination of key elements to punish such conducts. This situation that has been reviewed by the effort of recent case law and practice in the construction of the independent appearance of this law, an issue that has been refl ected in the latest laws and Codes published in Latin America regarding the comprehensive protection of infancy and adolescence.
