摘要：Los derechos Intelectuales se han visualizados como ese derecho que tienen el creador de producir y posteriormente gozar de los beneficios de su creación, de su ingenio. Basándose en este principio, es que muchas legislaciones han iniciado desde hace algún tiempo mecanismos legales que le permitan al creador disfrutar su obra y a sus descendientes. La realidad imperiosa de buscar estrategias legales que prohíban a personas inescrupulosas de aprovecharse de la obras del ingenio del creador en beneficio propio, y esto la hacen con la certeza que la penalización por ese acto ilícito es mínima, e incluso casi inaplicable, por cuanto las penas establecidas en la mayoría de las legislaciones de los países es muy débil. Motivo por el cual, es necesario establecer vínculos entre los derechos intelectuales y su respectiva protección con los derechos humanos del creador, resultando una labor más que necesaria, urgente. La protección de la creación y el derecho que le atañe al creador resulta el paso decisivo para muchos países exportadores y explotadores de creaciones e invenciones en cualquier área del conocimiento.
