摘要：O presente trabalho visa analisar quais as principais mudanças sugeridas para a reformulação da atual Lei 8.313/91, popularmente conhecida como Lei Rouanet. Legislação que incentiva os investimentos culturais no país, tendo como fomento a utilização de benefícios fiscais de imposto de renda como forma de abatimento do valor utilizado em projetos culturais. Visa, outrossim, analisar as críticas feitas à atual lei, bem como as melhorias que o novo projeto de lei pretende empreender, para democratizar a cultura do país, buscando tornar esses investimentos mais acessíveis a todos os estados da federação, e não apenas aqueles onde existem grandes empresas, maiores financiadoras culturais. Por fim, pretende-se fazer um comparativo entre a atual lei e sua modificação, observado o que deve ser mantido e o que precisa ser modificado para que ocorra a tão almejada democratização da cultura no país.
其他摘要：The present paper analyses the suggestions of possible changes in the 8.313/91 Law, known as “Lei Rouanet”. This legislation motivates culture investments in the country by allowing the use of fiscal incentives over the federal taxes on the same amount used on culture projects. This paper also analyses the common critics over the current law, and it suggests ways to improve the democracy of culture around the country, seeking ways to allow every State of the union to have a chance to access cultural projects, and not only to privilege some States, where the big companies reside. The present study is concluded emphasizing comparison between the current incentive law and the project that contains lots of modifications, comments on what should be kept and what needs to change to allow the anticipation of the Brazilian democratization of the culture.
