摘要：En el presente estudio, el autor realiza una descripción general del tratamiento legal y jurisprudencial del contrato bilateral de promesa en el derecho privado colombiano, tanto en el Código Civil como en el de Comercio. El autor se remonta a los antecedentes del contrato en el Código Civil francés, en los proyectos de código civil elaborados por ANDRÉS BELLO, para después estudiar temas como: concepto y elementos; función jurídico económica del contrato, principales características; diferencia con otras figuras contractuales; y requisitos. Finalmente aborda el estudio del contrato de promesa en el Código de Comercio. El estudio está soportado en la consulta de varias de las obras más importantes sobre la materia, así como en los fallos más relevantes de la Corte Suprema de Justicia
其他摘要：In this paper, the author refers to a general description of legal and jurisprudential treatment of the bilateral contract of promise in the Colombian law, so much in Civil Code as in commercial code. The author goes back to the antecedents of the contract in the French Civil Code, in the projects of civil code elaborated by ANDRÉS BELLO,he stops later to study topics like: concept and elements; economic juridical function of the contract, main characteristic; differs with other contractual figures; and requirements. Finally it approaches the study of the promise contract in the Commercial Code. The study is supported in the consultation of authors and sentences of the Supreme Court of Justice
