摘要：Este documento contiene una descripción sobre diversos aspectos del papel de la jurisprudencia en la historia del derecho comercial colombiano durante los últimos treinta años con una corta referencia a la jurisprudencia francesa. Evidencia la necesidad de fortalecer el papel de los jueces en el desarrollo del derecho comercial para evitar asuntos como la desjudicialización de los procesos, la privatización de la justicia en el arbitraje, la indebida e impropia interferencia de la Corte Constitucional en asuntos de comercio
其他摘要：This paper contains a brief description of some aspects of the judges in the history of the Commercial Law in Colombia with a reference to the French judicial system of commerce. Stands for the necessity of contribute to build a stronger justice for the development of Colombian Commercial Law to avoid some negative aspects such as the non concurrence to a commercial judge in some trials, the privatization of justice in arbitration tribunals and the collision of the scope of the Constitutional Court with Commercial Law issues (which should be out of its jurisdiction)
